Insurance company told to pay Rs 5 lakh as damages and settle claim

    A private insurance firm has been ordered by a city district consumer forum to pay Rs five lakh as damages to its client for refusing to settle his claim worth Rs 3.10 lakh for his stolen car and subjecting him to metal agony.

    Terming Cholamandalam MS General Insurance Company Ltd’s decision to reject Vasant Kunj resident Satya Deo Prasad’s claim for his stolen car as “arbitrary”, the New Delhi district Consumer Disputes Redressal Forum also asked the insurance firm to settle Prasad’s claim worth Rs 3.10 lakh.

    “We are of the view that opposite party (insurance firm) has simply acted in a rash and negligent manner in dealing with the claim and has arbitrarily repudiated it for no good reason and in the process caused harassment, mental agony and expenses to the complainant (Prasad) and thus is liable for imperfection and deficiency in providing insurance services,” said the forum’s bench, headed by President C K Chaturvedi.

    Prasad, in his complaint, said his car, which was stolen in June 2008, was insured with the firm for the period between July 2007 and July 2008 .

    The car was stolen on June 2, 2008, from Saket after which he lodged a First Information Report with the police and immediately informed the bank which had finance its purchase, he said.

    Prasad then informed the insurance firm about the incident on June 13, 2008, as the particulars of the company were not easily traceable as the original documents were in the stolen car, he said.

    Low investment returns will harden market, says Swiss Re

    The continuing low interest rate environment will force the insurance market to harden over the next year, Swiss Re Chief Economist Thomas Hess has told insuranceNEWS.com.au.

    Mr Hess, who was in Australia last week for client presentations, says the persistent low global interest rates are “basically a disaster for insurers” creating a profitability challenge as investment returns cannot be relied upon to bolster underwriting results.

    He says that while the balance sheets of insurers still look relatively strong, companies tend to under-reserve during periods of low investment returns and a “fair bit” of under-reserving will soon begin to become evident through adverse loss developments.

    While a natural lag exists between the beginning of a low interest rate environment and the impact showing up in profit and loss (P&L) accounts due to the timeframes of interest-based investments, Mr Hess expects that over the next year “the P&Ls of insurers will not look too good, especially for those that have chased business in the past few years”.

    As a result, companies will be forced to push up rates and the insurance market will harden.

    “It will lead to a global turn in the insurance cycle,” Mr Hess said.

    While the Australian market will feel the impact of any global hardening, Mr Hess describes both the economic and insurance situation in Australia as looking “brighter” than in many other parts of the world.

    He says the cat losses of 2010 and 2011 have now been digested and “not too much” capacity has been withdrawn from the Australian market.

    Renting property is a ‘relatively profitable’ investment

    LettingFocus.com has suggested that concerns raised by the Association of Residential Letting Agent (ARLA) that the rented sector is nearing capacity are unfounded.

    David Lawrenson, private rented sector expert at LettingFocus.com, suggested that strong demand for rental property is supporting the buy to let market.

    He said: “You would expect to see rising tenant demand in the current economic environment because people are reluctant to take on the responsibility of a mortgage.”

    Mr Lawrenson said that there is a possibility that an increase in rental yields will be encouraging more people to become landlords, which may in turn boost demand for buy to let insurance.

    An increase in rents means that purchasing property with a view to letting it is a “relatively profitable and secure investment”, Mr Lawrenson said.

    The latest figures released by the ARLA show that some 74 per cent of the organisation’s members think that demand is outstripping supply in the private rental sector.
